Micaela Rascovsky Case: Verdict Approaches

On Tuesday, the verdict was announced in the trial for the death of Micaela Rascovsky in Villa Urquiza on April 13, 2021. The Appeals Chamber reviewed the initial classification of femicide and changed it to abandonment of a person leading to death and aggravated minor injuries, which has raised uncertainty about the fate of Guido Pascuccio, the deceased's boyfriend and the only accused in the case.

During the trial, details were revealed that point both to Pascuccio's innocence and guilt. Although he was the one who notified the authorities about his partner's convulsion, the autopsy revealed that Micaela died from cocaine use, and it was discovered that she had died hours before the 911 call, in addition to having mentioned in previous chats that she was being abused.

Among the evidence presented was also a suicide note, placed five days after the young woman's death, in which she said goodbye to her loved ones and her boyfriend. DNA traces of Pascuccio and another person were found under the victim's nails, adding complexity to the case.

In light of this evidence, the judges of the Criminal and Correctional Oral Tribunal No. 10 must decide on the charges against Pascuccio. While the prosecution has requested 11 years in prison for abandonment of a person leading to death and aggravated minor injuries, the prosecution proposes a conviction for femicide, claiming that the victim suffered gender-based violence.

The judicial process began with the case cataloged as suspicious death, but after the family's participation as a plaintiff and the presentation of evidence, it was changed to femicide. The ruling issued by the court will be crucial to shed light on what happened that fateful morning in Villa Urquiza.
